Description

PESA provides the President of Treasury Board, Minster of Finance (Minister) with the legislative authority to issue directives that set strategic direction in public sector bargaining, including term and fiscal limits, and the means to ensure that government direction is met prior to agreement being reached. PESA also allows the Minister to request various kinds of bargaining related information around compensation, employment and labour market data from affected employers. The legislation applies to Alberta Health Services and related health care providers, and most post-secondary institutions, school boards (for education support services only) and select agencies, boards and commissions. The legislation does not apply to Teachers or the Alberta Public Service.

The Public Service Act governs the Alberta Public Service. The act establishes the Public Service Commission, allows appointment of the Public Service Commissioner and outlines the duties of the Public Service Commissioner, including the responsibility for administering the act. The act enables the delegation of powers and duties to designated officials, creates the classification and official pay plans, sets policy governing recruitment, selection and appointments, and provides for the conditions of service, including obligations of Designated Office Holders, and authorizes the Code of Conduct and Ethics and supplementary Codes for departments.

Description

The regulation sets out the process for compensation disclosure for public sector bodies that are being dissolved, amalgamated or otherwise are ceasing to exist. For public sector bodies that have already been dissolved, amalgamated or otherwise have ceased to exist, at the time of the coming into force of the regulation, the entity with custody and control of that body’s records will make the required disclosures. On a go forward basis, public sector bodies will make the required disclosures before they cease to exist. Failing that, they will provide the information necessary for the disclosure to the Government of Alberta, which make the disclosure. Failing either of those, the Government of Alberta will make the disclosure, in as complete a form as possible, using the information it has or is able to collect.
