Description
Alberta’s environmental legislation sets out requirements for the protection and wise use of the environment. If these rules are not followed, Alberta Environment and Sustainable Resource Development has a range of enforcement options, one of which is prosecution. When a prosecution results in a guilty plea or a finding of guilt by a trial judge, the court can decide to impose a creative sentencing order as part of the sentence. In 2013, eight new creative sentencing orders were issued by Alberta provincial court judges. Once an order has been imposed by the court, the environmental investigations liaison with Alberta Environment and Sustainable Resource Development monitors the completion of the project as laid out in the court document. The court can place conditions and require offenders to comply with the terms of creative sentence orders for up to three years.
