This Ministerial Order repeals clause 10 of Labour and Immigration Ministerial Order 18.2020 and the following is substituted: 10. Clause 9 of this Order applies to: (a) a layoff where the layoff notice is given to the employee on or after March 17, 2020, and (b) a layoff as a result of COVID-19 that is underway as of March 17, 2020.

This Ministerial Order, related to the Labour Relations Code and Employment Standards Code, is to comply with orders issued by the Chief Medical Officer of Health to combat the spread of COVID-19. This order applies with respect to the employers at a health care facility described in Chief Medical Officer of Health Order 10-2020, issued under section 29 of the Public Health Act, related to: a) work for more than one employer; or b) work at more than one worksite, as described in CMOH Order 10 (see related tab). Note: this order repeals Ministerial Order 22.2020 effective April 24, 2020.

The changes include a new job-protected leave for employees, scheduling flexibility, group termination notice requirements and a streamlined approval process for modifying employment standards rules. Note: Clause 10 of this ministerial order was amended by Labour and Immigration Ministerial Order 2020-27.
