Description

The Child and Youth Advocate Act provides the Advocate with the authority to investigate systemic issues arising from a serious injury or death of a child who was receiving child intervention services at the time of the injury or death. Under this mandate, the Advocate released the Investigative Review entitled “7‐Year‐Old Jack: Investigative Review” on January 21, 2014. The report makes five recommendations about five key areas related to practice and processes within Alberta’s child intervention system. This document presents the ministry response to the recommendations.

Description

The Ministry of Human Services has carefully reviewed the fatality inquiry report released on February 28, 2014 regarding the death of RJ on November 11, 2010. The inquiry found that this death was due to cardiac arrest and anoxic brain injury, resulting from traumatic injury to the cervical spine following a fall down a flight of stairs in his home. The manner of death was accidental. The fatality inquiry report made seven recommendations for preventing similar deaths. In addition to the fatality inquiry review, an internal investigation was conducted by the Central Region PDD Community Board in November 2010 and made eight recommendations for the service provider. The service provider has implemented all the recommendations.

The death of a young person affects everyone who is involved in the young person’s life. In August 2012, a youth who was receiving services under the Child, Youth and Family Enhancement Act committed suicide. It is hard to accept that a youth could believe the only option left to them was to end their life. This report provides the Ministry response to the OCYA five recommendations about four key areas related to practice and processes within the child intervention system in Alberta. In general terms, the ministry agrees with the findings of the report.

The report makes five recommendations for Human Services about the delivery of services for youth who are leaving Government care. The ministry acknowledges the intent of the Advocate’s recommendations. The report suggests that previous responses from government to address issues for youth in care have not been effective. A review of the Advocate’s previous recommendations suggests that the ministry has, in fact, made progress and followed through on many recommendations; however, we do recognize that new tools, guidelines and policies, while important, are only part of the solution to improving outcomes for youth transitioning to adulthood.

The Ministry of Human Services has carefully reviewed and considered the recommendations of the fatality inquiry report released on November 2, 2012, into the December 2006 death of Samantha Martin. The inquiry found this was a medical death due to natural causes, following the child’s return to parental care. Whenever possible, the ministry takes into account reviews of incidents involving children who were recently in care when identifying learnings that could lead to better services for children currently in the system.

They provide brief descriptions of the incidents where allegations of abuse of a child in care were substantiated by the OCYA, and the subsequent actions taken by the government in response to these allegations.
