This handbook is designed for elected officials, chief administrative officers, senior municipal staff and consultants to help understand and make informed decisions on what neutral third-party dispute resolution option would best meet their needs when resolving intermunicipal disputes. The handbook provides an overview of the four main dispute resolution options, how to select a practitioner, and frequently asked questions.

Description

The Subdivision and Development Appeal Board (SDAB) Training Guidebook is intended for municipalities, subdivision and development appeal boards, clerks and members to support the learning required for meeting the obligations of provincial legislation to conduct the subdivision/development appeal hearing process. The guidebook consists of six main components: guiding principles; Alberta planning framework; establishing an SDAB; appeals (basis of, procedure, further right, case law); mock-hearing with exercises; and, appendixes and forms. While recognizing the unique circumstances of each municipality, the guidebook is meant to serve as foundation for training and achievement of knowledge to ensure minimum standards of practice for planning decisions within a tribunal hearing setting.

Appeal board decisions shape the community and affect the lives of developers, neighbours, citizens, and businesses. The goal of this training manual is to provide individuals with enough information to be able to identify potential issues that may arise during an appeal hearing. The manual will support an appeal board in conducting effective hearings, making and writing legally binding decisions, and acting within the scope of its authority.

The Intermunicipal Dispute Resolution Initiative has been established to address disputes between municipalities or municipalities and another public agency. When parties are flexible and are interested in establishing or maintaining an ongoing relationship, we recommend the mediation process. Involving a third party to help develop solutions both parties can agree on, may help municipalities save money and avoid lengthy and unnecessary legal proceedings. This booklet has been designed as a guide to help you work through the mediation process. The contents describe the advantages of mediation, information on the mediation process, including how to choose a mediator, and a sample contract.

Description

The Subdivision and Development Appeal Board (SDAB) hears appeals from municipal subdivision and development authorities. SDAB decisions shape the community and affect the lives of developers, neighbours, citizens and businesses. It is important that the public have confidence in the quality of these decisions and the decision-making process. A need for SDAB training throughout the province has been identified. In an effort to meet this need, Municipal Affairs has developed this manual which is meant to be a guide to assist SDAB members. The manual provides general information in relation to the conduct of SDAB hearing but is not intended to be exhaustive or to provide any legal advice to the SDAB as a whole, its members or staff. Where appropriate, an SDAB should obtain independent legal advice.

The Ministry is committed to establishing and maintaining a roster of experienced mediators who are available to provide services to municipalities. The roster is not to be seen as a certification of competency of any mediator. Instead, the Ministry will provide municipalities with a list of mediators who have achieved a certain level of training and experience. It should be noted that the Alberta Municipal Affairs does not restrict the selection of mediators to its roster and municipalities are free to select a mediator who is not on the roster. The Ministry will use its roster in responding to requests for recommendations of qualified mediators.

Let's Resolve is an innovative program that provides mediation and dispute resolution support to municipalities who want to improve how they deal with conflict. The IDR Initiative is a service entered into voluntarily by municipalities who feel a neutral third party could help them get to an agreement. The MDRS team can help municipalities assess whether mediation or some other type of conflict resolution method is appropriate, and can help convene the process and ensure all the prerequisites are in place.
