Description

The Government Organization Act provides for the establishment of Government departments, including the designation of Ministers, appointment of Deputy Ministers, hiring of staff, procurement of expert services, and the formation of boards, committees or councils to advise on and/or carry out matters under the Minister’s administration. The Act also addresses matters such as the delegation of powers and duties, the development and delivery of programs and services, the formation of agreements, collection of fees, provision of grants, and acquisition/disposition of property. Ministry-specific powers, duties and functions are outlined in the accompanying schedules to the Act.

The Sustainable Fiscal Planning and Reporting Act sets out requirements and deadlines for public financial reporting, and establishes the government’s fiscal framework. The budget requirements include: preparing a three-year government strategic plan and three year ministry business plans, both with performance measures, preparing the fiscal plan on the same basis as the year-end financial statements and requiring three-year forecasts, assumptions on which the forecasts are based and their related sensitivities, and the forecast of government debt. The Act requires the Estimates / fiscal plan to be tabled in the Legislative Assembly prior to the end of February, and quarterly and mid-year fiscal and economic updates to be published on or before the end of August, November and February. PESA provides the President of Treasury Board, Minster of Finance (Minister) with the legislative authority to issue directives that set strategic direction in public sector bargaining, including term and fiscal limits, and the means to ensure that government direction is met prior to agreement being reached. PESA also allows the Minister to request various kinds of bargaining related information around compensation, employment and labour market data from affected employers. The legislation applies to Alberta Health Services and related health care providers, and most post-secondary institutions, school boards (for education support services only) and select agencies, boards and commissions. The legislation does not apply to Teachers or the Alberta Public Service.
