Description

The Act establishes the mandate of the Land and Property Rights Tribunal to determine and grant right of entry on the surface of any land, excluding Métis settlements, for any operation concerning mining, drilling, pipelines, and power transmission or telephone lines. The Act prevails over other instruments with respect to the right of entry to the surface of any land incidental to applicable operations. It does not apply to metallic/industrial minerals exploration or geophysical exploration, except on grazing leases or farm development leases.

Description

The Act provides the Government of Alberta with authority to administer, allocate, and enter into agreements with respect to minerals. It applies to all mines and minerals and related natural resources belonging to the Crown including wells, mines, quarries and minerals. The Act defines mines and minerals, and sets out how agreements in respect to minerals are established, renewed or cancelled. The Act is administered by Energy except for Part 8, which is administered by Environment and Parks along with the related Exploration Regulation and the Metallic and Industrial Minerals Exploration Regulation. All exploration for oil and gas, and metallic or industrial minerals requires approval by Environment and Protected Areas.

Description

The Technology Innovation and Emissions Reduction Regulation requires regulated facilities to reduce greenhouse gas emissions. The regulation applies to facilities which emit more than 100,000 tonnes of carbon dioxide. Facilities which emit less than the threshold may opt-in to the regulation, and conventional oil and gas facilities under the same ownership may be combined into a single aggregate facility. The regulation sets out high-performance benchmarks or enables the director to set facility-specific product benchmarks. To meet the emissions reduction requirement, facilities can reduce their emissions or use emission performance credits, emission offsets or pay into the regulated fund. Regulated facilities must provide annual compliance reports and facilities that emit more than 1 million tonnes of carbon dioxide must also provide a yearly forecasting report.

This regulation is a secondary statute that provides information pertaining to the administration of the Water Act including definitions of relevant terms and activities that can be performed under the Act and the requirements. Part 6 of the regulation deals with dam and canal safety and stipulates the key requirements and administrative details for the safety of these structures.
