In accordance with section 792.1 of the Insurance Act, the Alberta Superintendent of Insurance has adopted and issued the following Guidelines of the federal Office of the Superintendent of Financial Institutions (OSFI Guidelines), including future revisions, for provincially incorporated Property and Casualty Insurers, Life Insurers and Reciprocal Insurance Exchanges, either formed under the Insurance Act, or who have transferred to Alberta such that Alberta is their primary regulator (collectively known as “provincially regulated insurance entities”). This is the third edition of the Occupational Health and Safety (OHS) Code Explanation Guide. Its purpose is to explain the requirements of the Occupational Health and Safety Code 2009 in plain, easy‐to‐understand language. It presents information that helps clarify the intent or application of each rule or section of the OHS Code. In some cases extensive background information is presented so that readers have a better appreciation of the subject material. Readers making use of this guide are reminded that it has no legislative sanction. The OHS Code should be consulted for all purposes of interpreting and applying the law.

Description

Not all "problems" need to be solved by legislation (Acts or Regulations). Legislation should be used only when it is the most appropriate, i.e. when there is no other way to achieve the policy objectives effectively. Officials should focus on achieving a desired outcome, rather than assuming that a particular instrument, particularly an Act or regulation, will be effective. This involves determining the objectives and how these objectives can best be accomplished. The range of possible instruments available to accomplish policy objectives is very broad, allowing the Government to choose the type and degree of its intervention, if any. An Act or regulation should only be chosen after assessing the full range of possible instruments, including legislation.
