Description

Riparian areas on public land are the vegetation zones next to flowing and standing water bodies. Although they make up only about two per cent of the land in Alberta, they are often far more productive than the adjoining upland. Because of this, they are used extensively by wildlife, agricultural producers and recreationists. This backgrounder provides general information on the importance of riparian areas and industrial use of riparian areas.

The Public Lands Administration Regulation, or PLAR, is a provincial law of general application that applies to all persons including aboriginal peoples. However, aboriginal peoples do enjoy constitutionally protected rights to some activities on provincial Crown land in Alberta, such as hunting, fishing, and trapping for food. As a result, portions of PLAR may not be applicable to such persons doing these activities. This document sets out how PLAR implementation should be reconciled with these rights.

Sustainable Resource Development, Lands Division manages the use of public land for Albertans through the issuance of dispositions and authorities. Temporary Field Authorizations are a short-term authorization to allow use of public land for a specified activity. The Temporary Field Authorization Guidelines document is intended to serve as a training tool to ensure department staff understand their duties and obligations based on the delegated authority from the Minister under the Public Lands Act and Mines and Minerals Act. It is also made available as information to the public and industrial clients for the application of use of public land.

The Land Disposition Request allows the public to apply for agricultural use or sale of public land. When an application is received, Sustainable Resource Development evaluates the land to determine the appropriate land use and tenure. If the review results in a recommendation to sell or allow agricultural use, a land auction or tender generally occurs. This process usually applies to vacant (unallocated) public land.

Tax recovery lands are lands that were at one time privately owned. A large amount of land, mostly in southern Alberta, became tax recovery land. Drought, poor farming practices and the Depression led many people to forfeit their land as they were unable to pay municipal taxes. Since 1930, the province of Alberta has acquired some tax recovery lands and managed them as public land. Most of this land has been under grazing leases for decades.
