As part of the Government of Alberta’s commitment to be open and accountable to the public, all ministries are required to prepare and make public three-year ministry business plans. The ministry business plan encompasses the department and all consolidated entities, and aligns with the strategic direction of the Government of Alberta. Each business plan includes a description of the ministry, desired outcomes, priority initiatives, and performance measures and indicators. Current and forecast budgeting information for the planning period is also included.

Not all "problems" need to be solved by legislation (Acts or Regulations). Legislation should be used only when it is the most appropriate, i.e. when there is no other way to achieve the policy objectives effectively. Officials should focus on achieving a desired outcome, rather than assuming that a particular instrument, particularly an Act or regulation, will be effective. This involves determining the objectives and how these objectives can best be accomplished. The range of possible instruments available to accomplish policy objectives is very broad, allowing the Government to choose the type and degree of its intervention, if any. An Act or regulation should only be chosen after assessing the full range of possible instruments, including legislation.

At the beginning of April invitations, along with the discussion paper, A Single Trial Court as a Focus for Reform and a Catalyst for Change, were sent out to various stakeholders involved in the Alberta justice system. Invitees included lawyers, court clerks, members of the police service and others directly involved in the legal system such as mediators and arbitrators. As well, members of organizations such as sexual assault centres, Aboriginal groups, elder care associations, mental health associations, crime and violence prevention organizations and justice groups specific to various ethnic communities attended. Involved members of the community were also included such as victim’s services volunteers, members of Youth Justice Committees, as were provincial and municipal politicians, academics and psychologists.

In 1999, the Alberta Government sought the advice and direction of the public on a wide range of justice issues during Alberta’s first Summit on Justice. One of the messages the Government received was to simplify the justice system. Delegates felt that the system created delays, discouraged access, and, in some cases, resulted in citizens being denied justice. Since then, the Government has sought to improve the justice system through streamlining processes and through making better use of available resources. Alberta has two trial courts – the Provincial Court and the Court of Queen’s Bench – which both deal with criminal, family, and other civil matters. The concurrent trial jurisdiction shared by the two courts leads naturally to the question of whether one trial court could be doing the work now done by two. The purpose of this paper is to encourage consideration of whether trial court unification is a viable option.
