This document clarifies authorization and application requirements under the Water Act and the Water (Ministerial) Regulation where excavations into the ground are proposed. Typically, excavations into the ground that may trigger Water Act authorizations are dugouts, borrow pits, pits, or other pits/excavations. This guide does not address excavations that may be created for the purpose of drainage, flood control, erosion control, or channel realignment. Also not addressed by this guide is the issue of whether evaporative loss is considered a "diversion of water" under the Water Act.

In it, Alberta identifies significant flaws in the proposed regulations, modelling and impact assessment, as well as the absence of necessary federal financial support to achieve meaningful reductions. The technical submission does not alter Alberta's position that the proposed emissions cap is unconstitutional. As set out in Section 92A of the Constitution Act, 1867, Alberta has exclusive jurisdiction to manage the rate of non-renewable natural resources production and operational aspects of their development in the province.

In October 2020, Alberta and Canada signed the Agreement for the Conservation and Recovery of the Woodland Caribou in Alberta to facilitate woodland caribou recovery in Alberta. Alberta is committed to the implementation of this Agreement which supports provincial caribou recovery efforts including landscape-level planning, habitat conservation, management and recovery planning, caribou mortality and population management and caribou population and habitat monitoring. Alberta and Canada agreed to regularly report on the progress towards the commitments in this Agreement. This first report provides a summary of progress made and actions undertaken from January 1 to December 31, 2021.
